About the Court of Appeal
The Court of Appeal is the highest and final court in the land. It determines decisions from High Court and Industrial Court.
The Court of Appeal is currently going through the process of localization with 4 local Judges currently sitting on the bench. The other 4 Judges are expatriate Judges of Appeal. The Head of the Court of Appeal is the Judge President.
The Court of Appeal deals with two case types; criminal appeals and civil appeals. These can either be in the form of substantive appeals or applications (e.g. condonations or leave to appeal etc.) Appeals are to be filed within six (6) weeks of the decision of the lower court, High Court or Industrial Court. Court fees in the sum of P15.00 for Notice of Appeal and P6.00 for Applications are required to register the case.
In criminal cases, Prodeo Counsel is assigned to appellants in murder cases and any other case that has a constitutional connotation. In civil cases legal assistance is provided to poor litigants upon assessment as per Rule 30 of the Court of Appeal Rules.
